I just got the word via Facebook, Patients and Families United, and Montana NORLM that repeal of SB 423 is on the ballot for the 2012 election!

“…NEWS FLASH: The Secretary of State’s office just let the referendum campaign group know that I-124 has officially qualified for the 2012 ballot. Congratulations and thanks to the MANY hundreds of dedicated volunteers all over the state who spent their summers making this happen. It is a genuinely historic achievement!…”

YOU have done it Patients for Reform not Repeal, Montana Cannabis Industry Association, Rose you are wonderful,  and many more! I especially want to thank  ALL the volunteers, all the long hours, all the rejection at times, was worth it! Montanans have regained their voice. The next mile stone for the IR-124 is to see if there are enough signatures to overturn SB 423 until the 2012 election.

I want to give a shout out to all those evolved in the effort here in Bozeman. That is you Erin and all those at KannaKare, Dante, I hope I spelled that right, you know who you are, Monica Blanchard of Cannabis Caregivers of Montana Rick at Around the Clock Cannabis, and SOO many more. Without you guys the STOP SB423 movement would of had A LOT more to do!

Do not forget, this is just the beginning, NOW we must stay motivated to VOTE in 2012! I know, the world is going to END!!! BUT, if it does not…. VOTE!

Our hearing last week seemed to go well. Now we’re in wait-and-see mode
until the judge issues his decision on Thursday June 30th — just in time.

We don’t know what the judge will do, but we’re all hoping he enjoins
(delays) the entirety of SB 423, which will allow I-148 to prevail for a
while longer.

HELENA, August 1, 2011 – In just over two weeks, hundreds of volunteers throughout the state have collected more than 11,000 signatures for Initiative Referendum 124, the effort to place Senate Bill 423 on the November 2012 ballot, according to the petition sponsors.

“Our petition effort is succeeding because we have unbelievably dedicated volunteers and because so many people agree that any changes to our medical marijuana law should go to the voters first,” said Sarah Baugh, spokesperson for Patients for Reform – Not Repeal, which is organizing the referendum campaign. “Voters passed this law, and we should all have a say in what happens to it.”

Baugh continued, “Collecting signatures is hard work, and we are pleased with our progress to date. It will be a heroic effort by our volunteers to qualify this measure for the ballot. We might even be able to suspend the new law until Montanans can vote on it. We have momentum.”

In addition to crossing the threshold of 11,000 signatures as of July 31st, the petition campaign has begun turning in petitions to county officials for signature validation. So far, 2,500 signatures have been sent in. Within weeks, the campaign will have data on how many signatures are valid, and in which state house districts the measure is proceeding in. To qualify for the 2012 ballot, the petition needs at least 24,337 valid signatures from 34 different house districts.

According to Rose Habib, volunteer coordinator for Patients for Reform – Not Repeal, over 400 volunteers have been trained and are collecting signatures throughout Montana.

“Our volunteers have been fantastic,” said Habib, “they are dedicating their free time, time away from their families, to talk to thousands of Montanans about this petition. We are pleased with the voter support we are getting. We have 60 days, until September 30th, to gather another 60 to 70 thousand signatures from at least 50 plus house districts to suspend this awful law. This is a monumental effort that has only been done one time before in Montana, at a time when the rules and restrictions on petitioning were not as strict as those that are in place today.”

Montana’s laws on petitioning are rigorous, and organizers are taking precautions in training all volunteers to be sure they follow the law and don’t wind up wasting their own efforts by failing to complete necessary paperwork.

Baugh, the spokesperson for Patients for Reform – Not Repeal, said, “We can all agree that Montana needs effective regulation of medical marijuana, but SB 423 completely repeals what voters did, and replaces it with a new policy that won’t work at all, especially not for the state’s most severely ill patients. Ultimately, we believe voters will reject SB 423 and tell the Legislature to develop a better solution, one that will work for patients as well as for law enforcement and communities.”

!!UPDATE STOP SB423, Medical Marijuana Repeal in Disguise, Referendum, Injunction, Petition Signature Collection, Gathering Drive, June 20th- 21st UPDATE!!

As most of you now know, the language for the referendum to stop SB 423, repeal in disguise, from going into effect must be approved by the Secretary of State, Montana Legislative Services, and the Attorney General’s Office. The Secretary of State had approved the language and sent the petition on to Legislative Services. As a result of its review, Legislative Services has returned the language to the MTCIA with their concerns, which was an expected and anticipated part of the process. Not only does their input allow us the opportunity to refine the referendum language, it also provides insight as to any pitfalls that could be encountered up the road if medical cannabis opponents want to make trouble for us (which they will) by attacking minutia in the referendum’s language.

So, at this time, the language is being tweaked by an attorney to address the concerns of Legislative Services. These tweaks will make the referendum language more bulletproof.

Once we respond and submit a refined version, the proposed petition will continue on to the next steps required before a final petition receives formal approval for signature-collecting.

Thanks to everyone for their eagerness, and indeed impatience, in wanting to get this petition on the streets and racking up the signatures on behalf of Montana patients, voters, businesses, and families.

STOP /BLOCK SB 423 Petition Signature Efforts:

The MTCIA has received expressions of overwhelming support for a referendum initiative to block SB423.  We have heard from civil rights advocates, states rights advocates, medical marijuana supporters, patients and caregivers across the state.  One of the most common questions we get is – how can I help gather signatures?

Signatures may not be collected until the state approves the petition. We anticipate the petition receiving that approval in mid-to-late June. In the meantime, email petition@mtcia.org if you’d like to volunteer to help gather signatures when the time comes.

The Process

Here is a quick guide to the steps and pitfalls in this important effort.

  1. The Secretary of State received the proposed referendum petition on May 13th, 2011.
  2. The Secretary of State’s office will send the proposed text to Legislative Services for review.  They have 14 days to respond to the MTCIA.
  3. The MTCIA will respond to Legislative Services and send final text to Secretary of State.
  4. The Secretary of State forwards the final text to Attorney General.
  5. The Attorney General has 30 days to review and approve the language of the petition.
  6. During this time, training begins statewide for signature gatherers, notaries and other volunteers.  If you want to be a signature gatherer, email petition@mtcia.org.
  7. The Attorney General’s office provides a sample petition to MTCIA for circulation.
  8. Petitions are circulated, signatures are gathered according to strict rules and checked daily.
  9. Signed petitions are notarized and submitted to county election office for verification.
  10. Verified petitions are forwarded to Secretary of State to determine if SB423 is rejected and submitted to voters at the next general election.

The process of gathering signatures seems straightforward, but it’s easy to make big mistakes that can work against us.  Referendum drives have come under attack through the courts and have been made more complicated by new laws over the past four years.  We will need to be ready for the inevitable legal challenges.  Remember, some of our opponents are zealots and sadly, we should expect dirty tricks.  It is critical we get this right the very first time!

Some easy mistakes to avoid:

  1. Gathering signatures before the petitions are ready.
  2. Using signature gatherers who are untrained.
  3. Assuming our opponents will play fair.
  4. Assuming signatures will not be challenged in court.

HELENA, Mont. (AP) — Two Montana citizen groups are trying to do what has only been done once in the past 18 years: stop a bill from becoming law by petition.

One group proposes to prevent sweeping changes to the state’s medical marijuana law on July 1. The other wants to block a new law that has taken effect and gives utilities the power of eminent domain over private landowners.

If they get enough signatures from registered voters by Sept. 30, a referendum will be held on the bills in the 2012 general election. And if they get a lot more signatures, they can actually suspend the bill from becoming law until that election.

Legislative referenda are rare in Montana. They’ve only been tried three times since 1993, and only once was successful in suspendingbill.

“Having two at the same time is unique in recent history,” Secretary of State Linda McCulloch said Tuesday.

That’s no deterrent for John Vincent, a Democratic member of the state Public Service Commission and an organizer of the group behind the eminent domain petition.

“I’m anticipating full success. I fully believe we will not only get it on the ballot, but we will get it suspended,” Vincent said.

The bill he is fighting was pushed through the Legislature with the backing of businesses looking to jump-start two major electricity transmission projects: the Montana-Alberta Tie Line in the northern part of the state and Mountain States Transmission Intertie in the southwest.

Vincent said the measure strips landowners of their right to say whether the projects should go through their property.

The eminent domain bill and medical marijuana restrictions were spotlighted in a contentious legislative session that ended last month. Both bills passed out of the Republican-led Legislature after intense debate and scrutiny, and Democratic Gov. Brian Schweitzer let them become law without his signature.

The Montana Constitution allows voters to approve or reject any legislative act by referendum if 5 percent of the state’s total voters from at least 34 legislative districts sign a petition to place it on the ballot — currently 24,337 people.

But with the next general election not until 2012, both groups want to stop the laws / bills before they have time to take root and make lasting changes.

So they are aiming for the more difficult goal of blocking the laws from taking effect until the 2012 election. That takes the signatures of 15 percent of registered voters from 51 legislative districts.

The Montana Cannabis Industry Association, the group behind the marijuana bill petition, has submitted its proposed ballot language to McCulloch’s office and is searching for signature gatherers.

They will have to work fast to beat a July 1 deadline, the date the new law makes it tougher to qualify as a marijuana patient and outlaws for-profit marijuana businesses.

So in addition to the petition drive, the group is asking a state judge for an injunction that would to block the law. The group’s members scored an initial victory last week when Judge James Reynolds issued a temporary restraining order halting a portion of the new law: a ban on all advertising of marijuana and pot products.

“If we get the injunction, it buys us some time,” group spokeswoman Kate Cholewa said.

Vincent’s group has yet to file its proposed ballot initiative with the secretary of state, but its members have already announced plans for a June 13 kickoff to their petition drive.

He said his group or another interested group may take a page from the Montana Cannabis Industry Association and ask a judge for an injunction blocking the law, along with the petition drive. Even the threat of that happening could help their cause, he said.

“As long as there are serious legal and political question marks hanging over the eminent domain issue in Montana, there isn’t going to be, in my opinion, all that much activity in investing because it’s too risky,” he said.

The last time a citizen’s petition blocked a bill passed by the Montana Legislature was in 1993, when a proposed law to establish a flat state income tax rate of 6.7 percent was suspended and then shot down by voters in the next year’s election.

Since then, citizens’ petitions to block or repeal legislation have only been tried twice. The first, in 1997, involved a bill to prohibit corporate contributions to ballot issues. The petition drive was unable to block the bill, but it did receive enough signatures to get on the 1998 ballot, where voters upheld the new law. The bill was later ruled unconstitutional, making the referendum moot, according to McCulloch‘s office.

The second petition drive wasn’t aimed at blocking a law from taking effect, but only to get the issue on the next year’s ballot. That was in 2001, and the bill dealt with, among other things, extending electricity deregulation’s transition process to 2007. Voters rejected the bill in 2002.
