I just got the word via Facebook, Patients and Families United, and Montana NORLM that repeal of SB 423 is on the ballot for the 2012 election!

“…NEWS FLASH: The Secretary of State’s office just let the referendum campaign group know that I-124 has officially qualified for the 2012 ballot. Congratulations and thanks to the MANY hundreds of dedicated volunteers all over the state who spent their summers making this happen. It is a genuinely historic achievement!…”

YOU have done it Patients for Reform not Repeal, Montana Cannabis Industry Association, Rose you are wonderful,  and many more! I especially want to thank  ALL the volunteers, all the long hours, all the rejection at times, was worth it! Montanans have regained their voice. The next mile stone for the IR-124 is to see if there are enough signatures to overturn SB 423 until the 2012 election.

I want to give a shout out to all those evolved in the effort here in Bozeman. That is you Erin and all those at KannaKare, Dante, I hope I spelled that right, you know who you are, Monica Blanchard of Cannabis Caregivers of Montana Rick at Around the Clock Cannabis, and SOO many more. Senate Debates Senator Dave Wanzenried’s Senate Bill 185, Abolishing Montana’s Death Penalty

HELENA – The Senate Judiciary heard emotional testimony Tuesday over a bill that would end capital punishment in Montana. It’s similar to a measure that failed during the 2009 session.

One of the supporters of the measure is Diana Cote, whose teenage daughter was murdered in 2007. Cote said, “the thing that hurt the most was everyone kept asking me, ‘oh are you going to go for the death penalty’? I just didn’t get it, why after my own child being murdered would I want to go out and murder someone else?”

Cote supports Senator Dave Wanzenried’s Senate Bill 185 which abolishes the death penalty, instead setting the maximum penalty as life in prison without parole. Wanzenried said the families of defendants who are put to death should also be considered. He asked other lawmakers to spend 15 minutes inside a jail cell before forming an opinion on the death penalty.

Since 1974, 3 Montana inmates have been executed and the bill would change the fate of two inmates currently on death row. Randy Steid served 17 years in prison and was eventually proven innocent. He said abolishing capital punishment makes sure inmates who are wrongfully convicted aren’t put to death by mistake. He said, “let me tell you, when I was serving my sentence of life without parole and I would see those gurneys go by, if they would have asked me to jump on there I would have strapped myself in gladly.”

But, opponents of Wanzenried’s bill said the death penalty provides closure for the victims’ families. State Representative Tom Berry of Roundup knows firsthand about losing a loved one at the hand of another and he believes the death penalty needs to be an option. He said, “not a day goes by that I don’t think about my son who is no longer with us.”

Another part of the debate focused on the cost of incarceration versus putting someone to death. Wanzenried said it’s actually costs the state less to lock someone up for the rest of their lives. He said it costs $36,000 a year to house an inmate at the Montana State Prison. He said due to the lengthy legal process over capital punishment, it can cost 6 to 7 times more.

Seventeen states have abolished the death penalty, but opponents of the bill said 33 states will have the option.

Wanzenried currently sits on several senate committees: Finance and Claims, Highways and Transportation, Natural Resources and Rules committees. He is also on the Joint Appropriations Subcommittee on Health and Human Services.

In 2007-2008, he chaired the Environmental Quality Council, a product of the Montana Environmental Protection Act in our state constitution. He’s now moved over to vice-chair the Water Policy interim committee.

As water flows decline while the demand for water increases, there will be tensions amongst a large number of users: agriculture; municipal, hydroelectric, recreationists, fisheries,” he said. “In our efforts to plan for a drier future, we must preserve the rights of senior water rights holders, the cornerstone of Montana water law.”

HELENA, Mont. — It looks like the legislature has finally reached agreement on medical marijuana reforms. With just days remaining in the session, both houses are backing a bill that would drastically overhaul marijuana laws.It was heated debate in both houses over the last ditch effort to reform Montana’s medical marijuana laws. Senate bill 423 overwhelmingly passed both houses Tuesday. The bill takes the money and the industry out of medical marijuana. It also says a person must grow their own marijuana or find someone to volunteer to grow it for them. The bill would likely lead to a significant reduction of the state’s nearly 30,000 legal marijuana users supplied by large grow operations.Rep. Tom Berry (R-Roundup) says, “The initiative, I-148, when the voters voted for it, this brings it back to what the voters voted for. They did not vote for big shops. They did not vote for people selling it like it is. They voted so people could access it and that means for themselves.”Sen. Dave Wanzenried (D-Missoula) disagrees. Wanzenried says, “I don’t think it represents public opinion at all. Does it represent the concerns out there? Absolutely. And are there things we need to do to tighten up the system? Absolutely. But we are going to throw thousands of people with legitimate needs under the bus with this bill.Wanzenried thinks there are many questions the bill doesn’t answer. He says, “People who want to put an artificial constraint on it by saying you’re going to have to have a volunteer grow medical marijuana is absurd. There’s lots of people who will have it available illegally for them. And I don’t know how they’re supposed to find out who can legally grow it for them in the first place. That was one of the questions that was unanswered.”Rep. Berry knows the bill is not perfect, but also says the state must to severely cut down on the people with access to medical marijuana. Berry says, “I think the bill’s a good bill. It’s not a perfect bill, but I think it’s going to bring some side boards on the situation and get some more control to the medical marijuana situation. Which I think is out of control.”The bill still has to be voted on again in each house. It is expected to pass by the same margins it did Tuesday. Gov. Brian Schweitzer already said he plans to make changes to it, but observers say it’s too late for that. That has many worried Senate Bill 423 will turn people who can’t find someone to grow their marijuana into criminals.
